Terms and Conditions
These Terms and Conditions (T&Cs) apply to You when You play any game of 2Up.
These T&Cs do not constitute an offer, solicitation or invitation to play 2Up in any jurisdiction in which playing 2Up is illegal or prohibited. You are responsible for determining the laws and regulations that apply in the country in which You are resident or present for the purposes of 2Up.
In the United Kingdom, and other countries, gambling is illegal if it is conducted by persons under a certain age. In the United Kingdom, this age is 18. Accordingly, it is an offence if, being resident in the United Kingdom, You play 2Up and You are less than 18. PlayUp will not knowingly pay any winner of 2Up who is under the age of 18. If PlayUp deems it necessary, PlayUp will require any player of 2Up to affirm to PlayUp’s satisfaction his or her age. By playing 2Up, You are taken to affirm that You are of a legal age to play 2Up.
PlayUp is committed to promoting the awareness of problem gambling and improving prevention, intervention and treatment. Please review PlayUp’s responsible gambling policies and procedures, which You can find on the 2Up Website. If You have concerns about Your gambling or that of someone else, please visit www.gamcare.org.uk or call their confidential helpline on 0845 6000 133.
Notwithstanding anything contained in these T&Cs, if a dispute regarding the playing of 2Up arises, the decision of PlayUp is final. PlayUp will resolve any dispute as expeditiously as it can.
Definitions
In these Terms and Conditions:
2Up means the game called "2Up".
2Up Helpline means the telephone helpline that is available to answer queries You may have in relation to 2Up, contactable in the United Kingdom on 0845 389 1112.
2Up Match means a football match for which 2Up may be played and on which 2Up is open for entries, as listed on the 2Up Website.
2Up Goal means a selected Goal for which 2Up may be played.
2Up Wapsite means the wapsite at wap.play2up.co.uk
2Up Website means the website www.play2Up.co.uk
Accumulated Prize Pool means, in respect of a 2Up Goal, the relevant prize pool, plus any relevant Jackpot.
Eligible Participant means any person who is not an Ineligible Participant.
Ineligible Participant means any person whom PlayUp, in its absolute discretion, determines is not eligible to play 2Up and includes (without limitation):
- each director and employee of PlayUp, each director and employee of any promoter or advertising agent of PlayUp and the immediate family of each such director or employee (including a spouse, grandparent, parent, child and grandchild, whether by marriage, remarriage, adoption, co-habitation or other family extension);
- each person under the age of 18 years or who is otherwise a minor in any relevant jurisdiction for the purposes of playing 2Up;
- each person who is resident in or whose mobile carrier operates for the purposes of 2Up in a country other than UK or in which either the offering of, or participation in, 2Up is illegal or in which PlayUp is required to be, but is not, licensed or authorised to offer 2Up;
- each football player who is a member of either team (including its wider squad) or who plays in the league of either team, taking part in the relevant match that is a 2Up Match, and the immediate family of any such player (including a spouse, grandparent, parent, child and grandchild, whether by marriage, remarriage, adoption, co-habitation or other family extension) or any person otherwise co-habiting with that player;
- each person who does not have sufficient credit on a “pre-pay” mobile telephone to play 2Up;
- for a person that has an mobile account not in the name of the participant.
Jackpot means, in respect of a 2Up Goal, any amount of the Prize Pool from one or more previous 2Up Goals that has not been won by a valid 2Up entry.
PlayUp means PlayUp Interactive Gaming Entertainment (UK) Pty Limited.
PlayUp Group means each member of the PlayUp group, including revO Pty Limited and each affiliate of PlayUp and revO Pty Limited.
Playup Account means the account of each entrant that has either won a prize playing 2Up, or that has established an account online or from their mobile phone. You must be an Eligible Participant to establish a Playup Account. All winnings from 2Up will be paid into Your Playup Account, and you may redeem your winnings by visiting the 2Up Website.
Prize Pool means the amount that is available to be won and shared by all valid 2Up entries for that 2Up Goal.
SMS means short message service or text message.
You means each person who plays 2Up.
2Up Game
- The aim of 2Up is to predict the team, assister and scorer of the next 2Up Goal of a 2Up Match.
- You can play 2Up from the time the 2Up game is opened until the end of that 2Up Match.
- Each 2Up entry relates to only the next 2Up Goal i.e. to one 2Up Goal only. You may play 2Up on each 2Up Goal as often as You choose, however there is a restriction on the use of the premium rate number 89287 of £30 (i.e. 15 2GBP bets) per 24 hour period. Each entry, including duplicate entries, will be charged.
- Payment can be made by premium SMS, Pay4It or from a Playup Account.
- Entry via premium SMS to 89287 is charged at a premium rate to an ordinary SMS, two pounds sterling (£2). The cost of the SMS is charged to Your mobile telephone account or is deducted from Your credit balance if You have a “pre-pay” telephone, at the time that the Acknowledgement SMS is sent to Your mobile carrier. Costs associated with sending Your entry to 2Up are borne by You, are distinct from the cost of the 2Up entry itself, and are usually charged at Your usual rate for sending SMS.
- Payment by Pay4It is two pounds sterling (£2).
- Entry using your Playup Account can be made online and requires that there is sufficient credit on your account. Payment into your Playup Account (to top-up) may be made using UK debit and credit cards issued in the UK using the Playup website.
- A valid 2Up entry for the next 2Up Goal must include
- the name of a football club,
- the surname or jersey number of the assister, and
- the surname or jersey number of the scorer
In SMS's, item must be separated by one of the following characters: # , + _ or space " ". Team and player names that contain a space should be contracted such that the space is not included, e.g. Man United should be texted as MANU and Hussein Al Hakim would be ALHAKIM
- If PlayUp cannot understand or interpret your SMS entry, PlayUp in our absolute discretion will attempt to match your entry to a valid team, assister, and scorer using our automated system.
- It is possible, but not guaranteed, that non-understood SMS entries will be altered as described below.
- In the case of SMS entries, PlayUp will send a acknowledgement SMS to your phone. Your mobile carrier will then send confirmation to PlayUp that you have received this acknowledgement. Please note that it is only when PlayUp receives this confirmation of delivery that your entry becomes valid in a pool.
- However, if a goal is scored between the time that you send your SMS and PlayUp receives the delivery confirmation from your mobile carrier, 2Up will attempt to apply Your entry to the next 2Up Goal in that 2Up Match, if any remain and subject to You receiving the receipt SMS for that entry.
- PlayUp will not engage in any discussion regarding assists or goals. Guidelines used to determine assists are shown in the FAQ's.
- PlayUp is not liable for any failure to receive (either in a timely manner, or at all) any 2Up entry or receipt of successful delivery by reason of any loss of coverage or overloading of networks or any delay or failure caused by or of any telecommunications or other data transmission system, by or of a service provider or by any factor outside PlayUp’s control.
- Your SMS 2Up entry will be confirmed by a response SMS from PlayUp. Paragraphs below explain the responses You may receive.
- 2Up may not be timed to the television or radio broadcast of the match. 2Up is timed as closely as practicable to the actual match timing. A live television broadcast may be delayed to a viewer’s screen.
Prize pools
- The amount of a Prize Pool is shown on the 2Up website and 2Up WAP site, and is included in your confirmation SMS if playing by SMS. The actual Prize Pool may exceed the amount shown in any of these. However, note that the Prize Pool will be shared among all winners, so you may win only a share of the Prize Pool.
- If there is no winner for a 2Up Goal then that Prize Pool jackpots, increasing the value of the Prize Pool for the next 2Up Goal in that 2Up Match.
- At the end of the match, all outstanding entries are closed and deemed to have not won. The pool will jackpot to the next games played by the respective teams on a 50%/50% basis.
- From time to time, PlayUp may offer additional bonus prizes for particular Goal combinations, as described on the 2Up Website.
Winning
- You win if Your 2Up entry predicts the correct team, assister, and scorer of your entry's assigned 2Up Goal and you can prove ownership of the mobile telephone and account from which the winning 2Up entry was sent and that You are not an Ineligible Participant. If more than one valid 2Up entry correctly predicts the team, assister and scorer of the 2Up Goal the Accumulated Prize Pool is shared equally among all winning stakes.
- Winnings are paid into your Playup Account and payment from the Playup Account will be made by cheque upon your request.
- If an error is made in the calculation or notification of a Prize Pool, however caused, PlayUp reserves the right to recalculate the Prize Pool to correct the error. Any valid winning 2Up entries will then be paid out of the recalculated Prize Pool.
- The name of each winner of 2Up may be published by PlayUp, its agents or its service providers on the 2Up Website or on another medium selected by PlayUp. By playing 2Up, You consent to publication and waive any claim to any remuneration for publication.
- If You win 2Up,You are responsible for all insurance, tax or other costs associated with a 2Up prize. Where Your entry was submitted from a mobile telephone that is on account, the account holder is presumed to be the winner, unless the “real” participant can show otherwise. PlayUp will pay out to the person who claims the prize subject to appropriate proof of eligibility. PlayUp reserves the right not to pay if insufficient proof is given to it that the claimant is both the winner and an Eligible Participant. If there is a dispute between the account holder and the participant, PlayUp will determine in its absolute discretion who is deemed to be the winner, based on whatever evidence it deems necessary. PlayUp’s decision is final.
- There is an approximately 7 day turnaround time for Electronic Funds Transfer (EFT) payments, and 14 days for cheques.
Interpretation of SMS 2Up entry
- 2Up is designed to support the validity of Your 2Up entry. Your 2Up entry is run through an interpreter, whereby:
- The team name is matched against a list of teams for which 2Up can be played, including matching of a limited set of nicknames for team.
- In cases where the team name is ambiguous (e.g. "Manchester" could be Man. United or Man. City), PlayUp may attempt to select the correct team based on PlayUp's interpretation of the players included in your entry.
- The assist and scorer names are matched against a list of players on teams for which 2Up can be played. This includes the first names, surnames and jersey numbers of players.
- PlayUp may disallow entries for players who are not actually on the pitch.
- If your SMS entry contains an name that is used by two players on the same club (e.g. Cole) PlayUp will select the higher-scoring of two players. Players are advised to include the initial of the player in their SMS entries in such cases (e.g. ACole or JCole)
SMS Responses
- Once Your SMS 2Up entry is received by the 2Up server, PlayUp will attempt to send you an SMS response. The following explains the meaning of the SMS response You receive:
- If the SMS response indicates “You’re in”, then Your 2Up entry has been received and You are in with a chance of winning, for the next 2Up Goal after the time set out in that SMS response. If the prediction is different from that in Your 2Up entry, You sent a 2Up entry that needed to be interpreted in accordance with the rules set out above and the entry sent to you by PlayUp is your entry in the pool. The time indicated on the receipt SMS reflects the time of your entry, which may be later than the time that you sent your entry because of various reasons, including (without limitation) because of delays on the mobile network or your entry needed to be interpreted.
- If the SMS response indicates “You’re a 2UP Winner”, then you've won the amount indicated in the text, and have been assigned a win-code in the text. Please visit the 2Up website to collect.
- If the response indicates “Just please try again”, then PlayUp could not interpret your entry. Please re-submit your entry in the correct format.
- If the response indicates “No 2UP game in progress”, then you've attempted to make an entry when no 2Up game is being played. Please try again later.
- If the response indicates “Can’t find ’player’ in ’team’“, your entry contains a player who is either not in the team or not on the pitch. Please select another player and resend.
- If the response indicates “Can’t find any team with name “; your entry contains a team name that PlayUp could not interpret. Please resend with a valid team name.
- If the response indicates “Did you mean ’team 1’ or ’team 2’ ?“, your entry contains a team name that is ambiguous. PlayUp could not interpret which team. Please resend with a valid team name.
- If the response indicates “can't make out ur 2UP pick”,then PlayUp could not interpret your entry. Please re-submit your entry in the correct format.
General
- The game 2Up is run by PlayUp
- All rights, including copyright, trademarks and other intellectual property rights, in 2Up or in material supplied or made available as part of 2Up are owned by PlayUp and/or the PlayUp Group and/or any of their licensors and may not be duplicated or infringed in any manner by any person.
- By playing 2Up, You are deemed to consent to and to understand the T&Cs as posted on the 2Up Website and You represent that You are an Eligible Participant.
- PlayUp reserves the right at all times to vary, change, alter, amend, add to or remove any of these T&Cs by posting such changes on the 2Up Website. You are bound by any such variation, change, alteration, addition or removal.
- If You are an Ineligible Participant, you may not play 2Up or receive any prize. In case of accidental payment, any prize-money paid to You must be repaid by You.
- PlayUp accepts no responsibility for loss or damage that may arise from playing 2Up or for any other liability arising from You playing 2Up. All liability of PlayUp to You or to any other person, whether in tort (including negligence), in contract, under statute or otherwise, is expressly excluded to the maximum extent permitted by law. You release and agree to keep PlayUp indemnified from any claim, cost, demand, tax, liability or damage suffered or incurred by PlayUp or its directors, employees, agents or contractors arising out of Your playing 2Up.
- PlayUp reserves the right to require You to provide at any time such information as PlayUp deems necessary to satisfy itself that You are an Eligible Participant. If You fail to provide sufficient information that satisfies PlayUp, in its absolute discretion, that You are an Eligible Participant, You are deemed to be an Ineligible Participant.
- PlayUp reserves the right to withhold payment of any amount payable in respect of a winning 2Up entry, and/or to declare any 2Up entry void, if PlayUp, its agents or service providers believe for any reason that prize or pool manipulation or match-rigging has taken place as a result of which the integrity of 2Up may be called into question.
- PlayUp disclaims any responsibility for Your inability to play, to complete playing or to continue to play 2Up due to equipment or technical malfunction, overloaded or busy servers, lines or cell sites, inadvertent disconnection, Acts of God or any other reason whatsoever whether outside PlayUp’s control or otherwise.
- None of PlayUp, its agents or service providers are not associated with the running of any international, national or domestic domestic match that is a 2Up Match.
- Any personal information You provide to PlayUp is subject to the Privacy Policy set out below. The information PlayUp collects may include Your name, Your postal and email address, and Your telephone number, both home and mobile and your date of birth.
- Failure by PlayUp to enforce any of these T&Cs does not constitute a waiver of its right to do so.
Governing Law
These T&Cs are governed by the laws of England and Wales and PlayUp and You agree to submit to the jurisdiction of the English courts. By agreeing to the terms and conditions of use, you acknowledge and agree that the express licence granted to you under this agreement is for the use specified herein, is subject to the payment of the fees, and your strict ongoing compliance with each and every part of the terms and conditions of use.
